This Privacy Policy (“This Policy”) pertains to information Health Outcomes Sciences, Inc. (“HOS”) collects and receives from anyone who uses (“User” or “Users”) its website (“The Site”), www.h-outcomes.com, or its subscription services (“The Services”), which are made available through the HOS ePRISM® platform and made accessible via a proprietary website or IP address designated by HOS, or by other means, as applicable.

Use of The Site or The Services constitutes acceptance of, and consent to, all terms, conditions and provisions of This Policy.

  1. Age Restrictions. Users of The Services — and Users of The Site page that allows for placement of an order for The Services — must be at least 18 years of age; and therefore, the terms, conditions and provisions of This Policy apply solely to Users at least 18 years of age. IF YOU NOT AT LEAST 18 YEARS OF AGE, PLEASE DO NOT USE THE SERVICES OR THE SITE PAGE THAT ALLOWS FOR PLACEMENT PF AN ORDER TO THE SERVICES. Users of all other pages at The Site pages (i.e., other than the page that allows for placement of an order for The Services) must be at least 13 years of age. Consistent with the Children’s Online Privacy Protection Act of 1998 (COPPA), HOS will never knowingly collect or receive information from anyone who is not at least 13 years of age without the prior and express consent of a parent or guardian. No pages of The Site are directed to or designed for anyone who is not at least 13 years of age. IF YOU NOT AT LEAST 13 YEARS OF AGE, PLEASE DO NOT USE THE SITE AT ANY TIME OR IN ANY MANNER.
  2. Types of Information. HOS collects both “personally identifiable” information and “non-personally identifiable” information through The Site and The Services. Personally identifiable information may include name, company, title, street address, email address, phone number, credit card number, resume, comments, or other information which may uniquely identify a User of The Site or The Services. HOS does not collect personally identifiable information unless a User chooses to submit such information, which occurs only if a User completes a form at The Site, such as the Email Subscribe form, Contact Us form, Submit Resume form, Request Demo form, or other, or if a User places an order for The Services. Non-personally identifiable information may include a User’s internet protocol (IP) address, internet browser, internet service provider, operating system, referring site, search terms, pages viewed or other similar information which could indirectly (i.e., if combined with other online or offline information not associated specifically with use of The Site or The Services) be used to identify a User, but in practice is not. HOS collects non-personally identifiable information by means of cookies, web beacons, log files and/or other tracking technologies. By way of internet browser settings, Users have the option to accept all cookies, be notified when a cookie is set, or reject all cookies. To reject all cookies may result in some portions of The Site or The Services being inaccessible or unavailable in part or in whole.
  3. Third-Party Tracking. This Policy does not cover use of cookies or other similarly-situated technologies by third-party tracking companies/services. HOS has no access to, nor control of, such technologies.
  4. Social Media, Partner and Other Third-Party Links. The Site includes links to various third-party sites, for example, social media sites, such as LinkedIn and Twitter; business partner sites, such as American College of Cardiology; and sites at which press releases and other news-related publications are posted, such as Business Wire; among others. The process of clicking on any such links may result in the capture of a User’s internet protocol (IP) address and The Site page being visited at the time; also, the enabling of cookies. This Policy does not cover the results of a User’s interaction with these links, or a User’s interaction with the sites to which the links are directed. HOS has no control of such interactions, which are covered solely by the privacy policies of the third-party sites.
  5. Information Related to Data Collected By Users of The Services. Personally identifiable information associated with data entered and saved to The Services by a User of The Services (i.e., personally identifiable information regarding a User’s customers, patients, employees, representatives, consultants, contractors or agents that is entered and saved by a User during use of The Services) is not covered by, nor subject to, This Policy; such personally identifiable information remains the sole property of the User, and is covered by, and subject to, the privacy policy of the User. Certain information entered and saved to The Services may be considered protected health information (“PHI”) as defined in the Health Insurance Portability and Accountability Act of 1996 (Pub. L. 104-191, August 21, 1996, 110 Stat. 1936), 42 U.S.C. § 1320d – 1320d-8, as amended (“HIPAA”). Protected Health Information is retained, processed, transmitted and communicated in accordance with the HOS Business Associate Agreement effected within the HOS Services Agreement. HOS has no direct relationship with the individuals whose personally identifiable information may be entered by a User during use of The Services; any such individuals who seek to access to their personally identifiable information or any other adjunctive information entered and saved to The Services must contact the User.
  6. International Users. The Site and The Services are hosted in the United States of America. This Policy conforms solely to the privacy and data protection laws of the United States of America; it does not conform to, nor does it purport to conform to, the privacy and data protection laws of any other country. Users who reside in any other country, i.e., outside the United States of America, consent to: (a) the transfer of their data, including personally identifiable information, to the United States of America; and (b) the use of personally identifiable information as defined hereunder, in accordance with all terms, conditions and provisions of This Policy, without exception.
  7. Use of Personally Identifiable Information. HOS does not sell, rent, lease or otherwise distribute personally identifiable information to any third party. Personally identifiable information collected and received by HOS from Users of The Services allows HOS to configure individualized logins and to provide support-related activities. HOS may from time to time, and only when necessary, send notices by email to Users of The Services regarding important updates, changes or activities, such as intermittent periods during which The Services may be inaccessible due to system maintenance. Generally, Users of The Services may not opt out of such notices, which are not promotional in nature. Personally identifiable information collected and received by HOS from Users of The Site allows HOS to respond to specific requests or inquiries, such as to schedule a software demonstration or receive literature. HOS may from time to time send notices by email to Users who have expressed interest in products, services, open positions or general subject matter consistent with the HOS corporate mission or vision. All such notices to Users of The Site are delivered with an opt out option.
  8. Special Circumstances for Information Sharing and Disclosure. HOS may be required to disclose personally identifiable information under special circumstances, such as to comply with a subpoena or to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the HOS Services Agreement, or as otherwise required by law.
  9. Payment Information. Payment information collected and received from a User during placement of an order for The Services, specifically, credit card information, is neither accessible nor stored by HOS. Such payment information, and the associated payment transaction, is stored and processed by First Data Corporation, and is covered by, and subject to, the First Data Corporation privacy policy. First Data Corporation is a global leader in eCommerce and other payment processing services and technologies.
  10. Use of Non-Personally Identifiable Information. Non-personally identifiable information collected and received by HOS from Users of The Site or The Services allows HOS to uncover, analyze and benchmark User behaviors, trends and preferences, which may lead to changes and updates to The Site, The Services or the HOS corporate mission or vision, including but in no way limited to, new or modified features and functions associated with the Site or The Services, or new or modified sales and marketing initiatives. Any such changes or updates are intended to improve the overall User experience with The Site or The Services, and improve the ability of HOS to provide products and services of value and benefit to Users. HOS may regularly share aggregated statistics related to non-personally identifiable information with its business partners, shareholders, Board of Directors or other interested third parties, for example, the percent of Users who requested a software demonstration by completing the Request Demo form at The Site.
  11. Access to Personally Identifiable Information for Users of The Site.   12. Access to Personally Identifiable Information for Users of The Services.   13. Security. HOS follows generally accepted industry standards to protect the personally identifiable information submitted through The Site and The Services, both during transmission and once received. This includes encrypted secure socket layer (SSL) technology for The Site page that allows for placement of an order for The Services and for all other pages at The Site that require a User to provide login credentials or financial information (such as credit card information). No method of transmission over the internet or method of electronic storage is 100% secure. Consequently, HOS cannot warrant or guarantee the absolute security of personally identifiable information submitted through The Site or The Services. By submitting personally identifiable information through The Site or The Services, Users are acting on their own accord, and at their own risk. HOS implements reasonable administrative, technical and physical safeguards designed to ensure the security of personally identifiable information, and to protect against threats or hazards, including unauthorized or unlawful intercept, use or disclosure of, or access to, such information that could result in substantial harm or inconvenience to Users. However, such safeguards do not warrant or guarantee that a security breach will never occur. If HOS learns of a security breach, it will attempt to notify Users by any reasonable means, including posting details to The Site or by email communication (using personally identifiable information on file). If a User has the legal right to receive notice of a security breach in writing, based on city or state of residence, or if for any other reason a User wishes to receive notice of a security breach in writing, the User may request such notice in accordance the methods of contact outlined in Section 16.
  14. Transference of Personally Identifiable Information. In the event HOS undergoes a merger, reorganization or sale of substantially all its ownership interests or assets, or other change of control transaction, all personally identifiable information it has collected and received from Users of The Site or The Services may be transferred as permitted, and to the extent permitted, by applicable law.
  15. Policy Changes and Updates. HOS may change or update This Policy at any time for any reason. Personally identifiable information collected and received from Users is always subject to the most current version of This Policy, as posted to h-outcomes.com/privacy-policy. The date of the most current version of This Policy is specified in Section 17. Users are encouraged to review This Policy periodically. Continued use of The Site or The Services constitutes acceptance of, and consent to, all terms, conditions and provisions of This Policy.
